These Terms govern your use of the Divioma website and application. They are drafted for EU/EEA users and do not limit mandatory consumer rights under applicable law.
1. About Divioma
Divioma is an intermediary platform that enables customers and independent service providers to connect. We do not provide the services advertised on the Platform; we only provide the technical means for users to find each other and communicate.
Divioma acts solely as an information society service provider and hosting provider within the meaning of applicable EU law.
We are not a party to any contract or transaction between users. We are not an agent, representative, or guarantor of any user. We do not participate in financial settlements between users and do not guarantee that any user will pay or be paid. All arrangements for payment, cancellation, and performance are solely between the users concerned.
2. Eligibility and accounts
You must be at least the minimum age required by applicable law and have legal capacity to use the service.
You are responsible for keeping your account credentials secure and for all activity under your account.
By creating an account, you confirm that the information you provide is accurate and not misleading.
3. The marketplace and your responsibility
Providers are independent and set their own terms, pricing, and availability. Customers and providers are responsible for agreeing on the scope, price, timing, and completion of services.
The Platform does not verify the identity, reliability, or quality of users. Customers are responsible for assessing the reliability of providers before engaging them. Providers are responsible for assessing the reliability of customers. We do not guarantee the availability, quality, or outcome of any services provided by users.
Any ratings or reviews reflect the personal opinions of users and do not represent our views.
We are not liable for any acts or omissions of users. Use of the Platform and any dealings with other users are at your own risk.
4. User content and responsibility
You are solely responsible for all content you publish on the Platform (including messages, photos, descriptions, and any other materials). You must ensure that your content is lawful and does not infringe third-party rights or these Terms.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and otherwise use your content as necessary to operate the service.
You must not post unlawful, harmful, misleading, or otherwise unacceptable content or abuse the service.
We may remove or disable access to content where we receive a sufficiently substantiated notice alleging that such content is unlawful or violates rights.
Users must not publish allegations of criminal conduct, fraud, or other unlawful behaviour unless such statements are clearly presented as personal opinion and based on actual experience.
We reserve the right to remove any content that we consider unacceptable or that violates these Terms or applicable law, without prior notice. We reserve the right to suspend or terminate the accounts of users who violate these Terms or misuse the Platform.
5. Prohibited use
You must not misuse the service, including through fraud, harassment, defamation, hate speech, publication of personal data of third parties without consent, impersonation, scraping, reverse engineering, or interfering with the security or availability of the Platform or other users' use of it.
6. Payments and financial arrangements
The Platform does not participate in financial settlements between users. We are not a party to any transaction and do not guarantee payment by or to any user. We are not an agent of either the customer or the provider.
Any payment, cancellation, or refund arrangements are agreed and performed solely between the users concerned, subject to mandatory consumer rights where applicable.
If we introduce in-app or platform payment features in the future, additional payment terms will apply.
7. Intellectual property
The Divioma platform, its content, and branding are protected by intellectual property laws. You may not copy, modify, or distribute our materials except as allowed by law or with our prior written permission.
8. Limitation of liability and disclaimer of warranties
To the maximum extent permitted by applicable law, the Platform and related services are provided "as is" and "as available". We disclaim all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform or any dealings with other users, even if we have been advised of the possibility of such damages. Our total liability for any claims arising from or related to these Terms or the Platform shall not exceed the amount you have paid to us in the twelve months preceding the claim (if any), or one hundred euros, whichever is greater.
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law, including for death or personal injury caused by our negligence, fraud or wilful misconduct, or mandatory consumer rights in your jurisdiction.
